En cas de décès du souscripteur pendant la période d’appel de fonds, l’engagement souscrit est transmis à la succession. Les ayants droit deviennent alors responsables du solde des appels de fonds à venir, dans le respect des dispositions prévues par le règlement du fonds.

Si le décès survient après la période d’appel de fonds, les parts détenues par l’investisseur sont intégrées à son actif successoral. Elles sont ensuite transmises aux héritiers, qui deviennent porteurs des parts et bénéficient des droits et obligations y afférents.

Management of Fund Commitments in the Event of the Investor’s Death

In the event of the investor’s death during the capital call period, the outstanding commitment is transferred to the estate. The heirs are then responsible for fulfilling the remaining capital calls, in accordance with the fund’s regulations.

If the death occurs after the capital call period, the investor’s shares become part of the estate’s assets. These shares are then transferred to the heirs, who assume the associated rights and obligations as new unitholders.
